Our restructuring, bankruptcy and workouts practice has been involved in all aspects of restructurings and workouts including strategic positioning and alliances, structuring, coordination on litigation, asset divestitures, leveraged buyouts, debt repurchases, debt-to-equity swaps as well as DIP financing and refinancing for both publicly listed and private companies.
Our team has generally represented bondholders and creditors’ committees, individual creditors, bank syndicates, investment funds, hedge funds and other financial institutions. In some relevant cases, we have also assisted debtors and debtor’s special committees. Over the years, we have developed expertise in cross-border insolvency issues while working with US counsel in Mexican aspects of proceedings under Chapter 11 and Chapter 15 of the US Bankruptcy Code, securities registration exemptions under the 1933 US Securities Act, and exchange offers of registered securities under the exemption of the US Bankruptcy Code.
We have participated in Mexican pre-pack insolvency proceedings and have worked in domestic (Concurso Mercantil) and cross-border insolvency proceedings across different industries and sectors, including commercial aviation, telecommunications, steel, real estate, energy, mining, banking, financial services and insurance.
