About

Provided by McDermott Will & Emery LLP

Our electric regulatory practice is best known for being the nation’s “go to” team for independent power producers and other competitive power companies and for the overall breadth and strength of our FERC and appellate capabilities. Over the past year, our lawyers have continued to play leading roles in virtually every major FERC proceeding – as well as related appellate proceedings – affecting competitive power companies, including power marketers and merchant transmission developers.

McDermott lawyers provide comprehensive counselling and representation on the full range of energy regulatory, reliability, markets, transmission, interconnection, and compliance matters, including electric matters arising under the Federal Power Act (the “FPA”), the Public Utility Regulatory Policies Act of 1978, the Public Utility Holding Company Act of 2005, the Energy Policy Act of 2005, and the Dodd-Frank Act, and our lawyers regularly represent clients in complex energy regulatory litigation before, and investigations and audits by, FERC, the CFTC, and other federal and state regulatory bodies, and in related appellate and alternative dispute resolution proceedings. We also advise clients seeking to comply with the ever-changing regulatory requirements of FERC and other agencies, reliability standards and requirements adopted by NERC and regional reliability organizations, and market rules and protocols of the various ISOs and RTOs.
