Jones Day is representing JP Morgan Securities LLC in two putative class actions filed in the Southern District of New York by Brazilian plaintiffs alleging potential environmental harm caused by dams owned by Vale SA, to whom JP Morgan Securities and other bank defendants have provided financing. Plaintiffs allege that Vale's dams are at risk of collapsing, and argue that the defendant banks should be held liable as 'indirect polluters' by reason of their having financed Vale's operations.
