The Hill Dickinson Court of Protection team continues to advise on numerous complex Court of Protection cases including welfare/treatment issues, detention and treatment under the Mental Health Act, contact, residence, Deprivation of Liberty authorisations, consent to treatment, withdrawal of treatment.

We are regularly instructed to attend court at short notice and on an urgent and out of hours basis on medical treatment cases. Two of our team have Higher Rights (Civil Proceedings).

Alongside our public sector practice, we continue to build a growing client base in the private provider sector as the issues faced in the public sector in the provision of treatment to those assessed as lacking capacity to make personal and welfare decisions are the same.

Experience:

  • The combined team has been involved in the majority of the lead cases in this area:  Aintree University Hospitals NHS Trust v James [2014]; Briggs v Briggs [2016]; Re X (Deprivation of Liberty); Re N v A CCG.
  • Our Court of Protection team from our Manchester office was the lead team in the Alfie Evans case that received unprecedented national and international press.  
  • Our London Court of Protection team,  support the lawyers engaged in this area of work in attaining Higher Rights so that they too can undertake advocacy without the need to instruct external Counsel.
