GRSM’s Pennsylvania insurance group counsels insurers, regionally and nationally, in complex, high risk, and high exposure situations. We place strong emphasis on working proactively, not reactively. Our thorough initial evaluation and advice frequently enables us to guide our clients to practical resolutions with policyholders without litigation. As needed, we fully litigate cases through trial and appeal.  

Our team has established numerous favorable appellate precedents on novel questions—often on issues of portfolio importance to their clients and the industry. Areas of concentration include first and third-party insurance, in both commercial and personal lines, insurance bad faith (where our team established the standard under Pennsylvania’s bad faith statute), and D&O and E&O claims-made policies.

Representing insurers in complex, multi-insurer coverage situations in the mass-tort context, including policyholder bankruptcies is an area of particular focus and strength, especially in the long-tail toxic tort, environmental, and sex abuse contexts. Our engagements have frequently included negotiating CIPs or policy buyback agreements, litigating coverage issues in multi-insurer cases, drafting policy language, and protecting insurers in bankruptcy proceedings of policyholders, including in a case that a group member argued before the United States Supreme Court.
