About

Provided by Borden Ladner Gervais LLP

BLG’s Hotel & Hospitality group acts for developers, owners, managers, brands and lenders. Our lawyers have a practical understanding of the dynamics between all of the parties, the realities of hotel investment and operations and the legal and market challenges that face this industry.

We advise on major hotel developments, including mixed-use branded residence projects; act for buyers and sellers of iconic hotels across the country; put in place sophisticated construction and term loan facilities; and work with issuers and underwriters involved in hotel real estate investment trusts. In addition to handling hotel transactions and developments, a significant part of our practice relates to the management of hotel properties, including labour and employment contract negotiations, leases to commercial tenants, permitting matters with provincial and municipal authorities, and environmental issues. We have extensive experience negotiating hotel management agreements and dealing with day-to-day issues that arise under them, including resolution of disputes relating to operational and performance obligations and brand standards.

A particular strength of our practice is with respect to hotel franchise matters. BLG has acted for many owners, and a number of Canada’s most significant franchisors, in both agreement preparation and litigation. This experience allows us to quickly and effectively work through the complexities of franchise and hotel management agreements.
