Attorneys in the Barnes & Thornburg’s bankruptcy practice advise clients nationwide on complex, multi-jurisdictional restructurings and insolvency matters. Our practice also provides guidance in municipal insolvency and Chapter 11 and Chapter 9 matters, offers landlord representation in large retail and commercial restructurings, assists with distressed real estate workouts, and advises on asset sales under Section 363 of the Bankruptcy Code. Additional capabilities include advising pre-petition and DIP lenders, indenture trustees, receivers, and investors, as well as providing integrated support for clients addressing distressed asset issues across regulated industries, including healthcare, energy, real estate, higher education, and public finance. We also represent clients in resolving disputes outside the courtroom through negotiation, arbitration, and mediation. Our department members are frequently consulted on planning and documenting transactions, formulating strategic settlements in litigated matters, and negotiating and documenting pre-bankruptcy modifications and forbearances.
