Occupational Safety and Health

Baker Botts’ OSHA and workplace safety team delivers a full-service approach to environmental and occupational health and safety, partnering with clients, regulators, and other stakeholders on industrial hygiene, compliance, and enforcement. We counsel and defend companies before OSHA and advise pipeline owners and operators on safety obligations under PHMSA and related state requirements. Our lawyers help clients interpret and implement the General Duty Clause and specific OSHA standards; address workplace exposure issues involving asbestos, noise, nuisance dust, and other hazardous materials; and manage pipeline safety programs. When enforcement arises, we represent employers in Department of Labor administrative proceedings, appear before Administrative Law Judges and the Occupational Safety and Health Review Commission, defend Section 11(c) whistleblower retaliation claims, and handle appeals when needed. We also design and implement occupational health and safety management systems to support continuous improvement.
