BKL’s Customs & International Trade Practice Group provides comprehensive solutions that satisfy clients’ needs in response to rapid changes to the customs/trade environment that create risks arising from the increasing numbers of free trade agreements, cross-border inter-company transactions by multinationals, new businesses such as virtual assets, intensified customs audits, and increased protectionism of domestic industries in trade policies. 

Notably, BKL has defended a number of anti-dumping cases brought by the Korean government and has done so with an outstanding success rate. Much of the credit for its vigorous anti-dumping defense practice goes to members of this practice group who are able to call upon a rare background of extensive work experience with the Korean International Trade Commission and the Ministry of Commerce, Industry and Energy.

BKL is regularly retained to advise trade-related bodies in relation to certain aspects of their policy-making, including the Ministry of Justice, the Ministry of Foreign Affairs and Trade, and the Ministry of Commerce, Industry and Energy. BKL finds that this participation in policy-making serves as an important complement to its practice on behalf of private entities.

What the Team is Known For

Bae, Kim & Lee has a well-respected international trade law practice in South Korea. It advises clients on contentious and non-contentious matters such as anti-dumping issues, trade remedy measures and customs investigations, as well as tariff valuations. The firm often acts for governments in arbitration relating to FTAs and ICSID proceedings, in addition to representing Korean companies and multinational corporations in handling origin verification issues under FTAs. It is regularly engaged to advise on investor-state disputes arising from international investment treaties. The team is also active in the provision of advice relating to sanctions.
