After more than 8 years of litigation in court, the judge confirmed: Mogoșoaia Palace remains the property of the Bucharest Municipality.
Pursuant to the decision rendered on May 22, 2018, the Bucharest Court dismissed as inadmissible the motion filed for the retrocession of the Mogosoaia Palace.
The Bucharest Municipality was represented in this case by Nestor Nestor Diculescu Kingston Petersen (NNDKP), and the trial strategy was coordinated by Ana Diculescu-Sova, Senior Partner and Coordinator of the Dispute Resolution Practice of the firm.
During the 8 years of legal representation, the team also included Sorina Olaru, Partner, Peggy Șuică-Neagu, Partner, Daniela Ghervas, Senior Associate, Mihaela Ceausescu, Associate, Elena Trișcariu, Associate and Emanuel Bondalici, Associate.
The legal team addressed difficult issues that required a thorough analysis of the evolution of legislation on property, of the jurisprudence and legal studies throughout the years, and was confronted with the difficulties inherently associated with consulting old documents and archive research.
"Preparing the representation strategy in such a peculiar case requires attention to detail and a great deal of creativity. We are pleased that we could use the experience we acquired through decades of practice in the case of the retrocession of Mogoșoaia Palace, and that we could assist the court in making the right decision, which will have beneficial effects on the community. I would like to congratulate the NNDKP team who contributed to the development of the judicial practice in a highly volatile field, proving the strength and creative force of the team as a whole, and of every one of us when we join forces", declared Ana Diculescu-Șova.
NNDKP's Litigation practice is recognized as a force in the area of dispute resolution, being constantly top-ranked by reputed international guides, such as Chambers and Partners (the European edition), from 2007, and The European Legal 500 guide, from 2002. With 10 Partners coordinating a team of more than 50 lawyers, NNDKP has the necessary resources to handle complex cases, which include several parties or extend over many years, and can offer sustainable strategies in order to mitigate potential future risks.
The decision of the court may be challenged before the Bucharest Court of Appeals.
