With effect from 1 July 2024, there is a new criminal law regime in India. The former criminal laws dealing with criminal offences, criminal procedure, and evidence have been repealed and replaced by three new statutes.

The Indian Penal Code, 1860 (IPC), which defined offences and prescribed punishments, has been replaced by the Bharatiya Nyaya Sanhita, 2023 (BNS). The Code of Criminal Procedure, 1973 (CrPC), which set out the procedure for criminal proceedings, has been replaced by the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). The Indian Evidence Act, 1872 (IEA) has been replaced by the Bharatiya Sakshya Adhiniyam, 2023 (BSA).

Over the next few weeks, DSK Legal will release a series of articles to discuss the key changes made by the new criminal laws of India. Our endeavour is to not only give you conspectus of the changes, but also take you through the process of the new criminal justice system in India.
