Argus Partners is pleased to announce that it successfully represented JMS Mining Private Limited before the High Court for the State of Telangana in a significant arbitration matter concerning the maintainability of a challenge under Article 227 of the Constitution against an order passed by an arbitral tribunal dismissing an application under Section 16 of the Arbitration and Conciliation Act, 1996.
By its judgment dated July 14, 2026, the High Court dismissed the Civil Revision Petition filed by Singareni Collieries Company Limited, reaffirming the settled position that an arbitral tribunal's rejection of jurisdictional objections under Section 16 cannot ordinarily be challenged under Article 227 and must instead be assailed under Section 34 after the arbitral award is rendered.
