Steven T. Miano’s practice includes all facets of environmental law and litigation, from advising clients on regulatory changes to negotiating with state and federal agencies to litigating complex disputes. He regularly handles federal and state cases arising under the Clean Water Act, Superfund, brownfields redevelopment statutes, Hazardous Waste laws, the Clean Air Act, the Toxic Substances Control Act, and toxic torts. Steve is particularly adept at handling water cases, Superfund, vapor intrusion, RCRA, and most recently, has become a resource for companies and municipalities navigating PFAS advisories, regulatory changes and litigation.

Steve also guides clients, including large industrial corporations, commercial entities, municipalities, and not for profit organizations, through corporate transactions. This work involves conducting due diligence, drafting environmental provisions for contracts, negotiating with permitting authorities and allocating responsibility for environmental conditions. Once the deal is done, Steve provides counseling on compliance, ongoing environmental liabilities, and risk reduction. Steve has also assisted clients with environmental audits and management systems.

Before entering private practice, Steve was an Assistant Regional Counsel for the U.S. Environmental Protection Agency, Region III, Hazardous Waste Branch, where his practice focused on Superfund, hazardous waste laws and criminal enforcement.

Professional Memberships

Steve is a past Chair of the American Bar Association’s Section of Environment, Energy, and Resources, a bar association with more than 9,000 members nationwide and in numerous foreign countries. He is also a Fellow in the American College of Environmental Lawyers. Steve has served on a number of planning committees for, and spoken at many statewide and national conferences.

Work Highlights

- Represented a group of state senators and municipalities before the Third Circuit, obtaining a precedential decision rejecting, on standing grounds, a challenge to a ban on fracking in the Delaware River Basin. The decision protects the four-state river basin, and clarifies as to when state legislators do or do not have standing to bring litigation.

-Advising a regional company on a significant environmental remediation of property in NJ under NJ state environmental laws.

- Obtained a favourable settlement for a manufacturing client in negotiations with the EPA and other responsible parties for remediation of a superfund site in New York City.

- Represented a national defense corporation in Superfund actions filed in several parts of the country.
