Practice Areas
Scott’s career focus on the representation of states, ratepayer advocates, labor unions, and municipal and consumer-owned utilities has helped to reshape the landscape of regional electricity markets, creating millions of dollars in savings for his clients and their consumers, while helping to ensure the quality, reliability, and sustainability of utility services. He has served as lead counsel in proceedings before the U.S. Supreme Court and federal appellate courts, as well as in numerous federal and state administrative agency matters.
In recent years, Scott has argued (on behalf of the state commissions of Maryland and New York, respectively) two of the more significant federal court decisions involving the interplay between the Federal Power Act and state energy policy: PPL EnergyPlus, LLC v. Nazarian, 753 F.3d 467 (4th Cir. 2014), aff’d sub nom. Hughes v. Talen Energy Marketing, LLC, 578 U.S. 150 (2016), and Coalition for Competitive Electricity v. Zibelman, 272 F. Supp. 3d 554 (S.D.N.Y. 2017), aff’d, 906 F.3d 41 (2d Cir. 2018), cert. denied sub nom. Electric Power Supply Ass’n v. Rhodes, 139 S. Ct. 1547 (2019).
