Restructuring and insolvency
Clients include national and regional firms of insolvency practitioners and receivers, funders and institutional/individual creditors, business owners, directors and other stakeholders. Mark's practice includes all varieties of business structures and personal insolvency. Highlights: advising directors of 'Farepak' in defending £42m claims for breach of duty and wrongful trading, associated companies act investigation, directors disqualification and professional disciplinary proceedings; advising a firm of solicitors on restructuring their partnership when faced with a disputed claim (£2m) by trustees of a final salary pension scheme; advising administrators of a national chain of retail stores on claims against them for conversion of stock claimed to be supplied on ROT terms; acting for liquidators in various claims against directors for malfeasance, unlawful dividends, preferences and transactions at an undervalue (including similar claims against members of an insolvent LLP) and claims relating to civil liabilities arising from acting as a director whilst disqualified; advising an international vehicle manufacturer on protecting its interests after the appointment of administrators over several dealerships and advising secured creditors on the enforcement of claims against companies/guarantors.
