Work Highlights

Representing the interests of strategic Ukrainian State-Owned Enterprise “Ukrhydroenergo” at the ad hoc arbitration under the auspices of the London Court of International Arbitration (LCIA) in a dispute with Fichtner GmbH & Co. KG concerning the rehabilitation project: Increasing the capacity of Kakhovka Hydroelectric Power Plant.

Representing the Client before Ukrainian commercial court in a dispute with one of the largest Ukrainian banks. The Bank filed a claim against the Client and Ukrainian LLC seeking to invalidate the agreement for the provision of the guarantee and the guarantee itself to avoid payment of EUR88 million. AGA Partners defends the client on the merits of the dispute. The case is at the preliminary stage of the proceedings.

Representing the Client’s interests in the proceedings before GAFTA first-tier tribunal and appeal board as well as before English High Court in respect to World Freezing Order against the claim of Russian company (seller) for delivered but unpaid goods. The case concerned the claim of the seller for the price of the goods, and the buyer’s defence by arguing that the goods delivered were not of contractual quality.

Advising a major Ukrainian agriholding on the execution the contracts and applying a force majeure event during the war in Ukraine. Iryna advised the client concerning the several cargos that were loaded before the war started and was blocked by in Ukrainian port. The vessels have been idle in a Ukrainian Black Sea port for almost 6 months and could not leave due to mining of the Black Sea by russian army.

Representing the Client in Kyiv Appeal court in a dispute concerning the enforcement the GAFTA Award in Ukraine under New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.

Representing the Client/seller (Switzerland) with regard to the contract on sale of sunflower oil on DAP delivery terms. In particular, the buyer, being a large agri-trading company incorporated in United Arab Emirates, refused to take partial delivery of the goods under the contract, causing accrual of significant market damages for the Client.

Representing the client before the Refined Sugar Association (RSA) in an arbitration that was commenced by one of the world's leading traders in soft commodities. The opponent demands damages for alleged non-performance of the sales contract (failure to deliver the goods) by our client.

Successfull representing the Client in four separate GAFTA first-tier arbitration proceedings in arising out of the contracts for purchase of Ukrainian origin corn. In particular, the Client claimed damages for failure of three sellers to deliver the goods under four sale contracts, which were fully satisfied by the Tribunal.

Representing Swiss trading company (Charterer) in LMAA arbitration proceedings, commenced by a vessel owner’ company (Owner), incorporated in Marshall Islands, under a voyage charterparty. The matter emerged due to the Owner’s claim for demurrage, allegedly sustained due to the vessel’s detention at the port of discharge.

Developing a strategy of defence for the client in the proceedings commenced by the opponent in Ukraine to recognize and enforce an arbitral award at the London Court of International Arbitration (LCIA) against the Client.

Representing client’s interests in the first instance of FOSFA arbitration, in dispute with one of the largest German agricultural holdings concerning execution of the contract on conditions of FOB, nomination of the vessel and omission of the time bar of claim. FOSFA award was willfully executed by the defendant with repayment amounting more than USD 400,000 in the client’s favor.

Representing freighter interests in LMAA arbitration in dispute with one of the largest ship holders in Black and Caspian seas region concerning estimation of demurrage\dispatch. Client’s demands were fully satisfied. LMAA arbitrament was willfully executed by the ship holder with payment of dispatch in favor of the client as well compensation of all legal expenses.

Representing client’s interests in the first instance of GAFTA arbitration in a dispute with Hong-Kong company concerning execution of CIF contract, recovering damages given default and demurrage. All client’s claims were satisfied. AGA Partners’ team is handling the case at the stage of enforcement in Hong Kong.
