Advising Forsters in a class action against Old Mutual and Friends Provident International, two major life insurance companies in the Isle of Man. The claim in total is worth in the region of £270,000,000 and has potentially significant consequences for the life insurance industry. Ed Cummings KC is also providing legal advice.
This case will be one of the first class actions to take place in the Isle of Man so is also significant from a procedural point of view.
Whittles acted for the successful Appellant Beneficiaries in setting aside a decision of the Isle of Man High Court not to bless the decision of the Trustee, which it had arrived at and then subsequently made a Court application per Section 61 Trustee Act 1961. The successful Appeal was then the subject of an unsuccessful application by another beneficiary for special leave to the Privy Council.
Acted for 7 successful Defendants in setting aside various applications for extensions of time to serve claim forms, worth over £5million.

Acting for the Claimants in pursuing a company that was the subject of a high value cyber attack.
Acting for the liquidators of Montreux Healthcare Fund in an application for a Court Supervised Liquidation, which is supported by the Isle of Man Financial Services Authority on public interest grounds as it is an Isle of Man fund, once valued at £426 million, which is now thought to be insolvent.
Acting for one of the two Claimants in a claim to wind up a high profile, very large property development business.
Our firm took the lead in the advocacy at Court to deal with the winding up.
Acting for the Applicants in an Application to discharge freezing order as part of an alleged massive international tax case.
Acting for Odin Fiduciaries in relation to a number of entities that have been the subject of property freezing orders and are pursuing various actions against previous trustees and trust advisors.
