Gerard Rothschild practises commercial, competition, energy and public law.
Recent notable commercial law cases include: Prismall v. Google (representative proceedings for misuse of private information); Stokoe v. Grayson (cross-examination on Norwich Pharmacal affidavit); and Micula v. Romania (Supreme Court on enforcing ICSID awards). From postgraduate studies, he has interests in restitution and the conflict of laws.
In competition law, Gerard’s recent experience includes: Evans v. Barclays (Court of Appeal on collective proceedings orders); acting for a class of electricity billpayers affected by the power cables cartel; and the Meta/GIPHY merger investigation. He is a contributing author of Competition Litigation: UK Practice and Procedure (OUP).
As to public law, experience of note includes: constitutional litigation before the Falkland Islands Supreme Court; acting pro bono for Charlie Gard’s parents challenging the restriction of medical treatment for their child; and R (Good Law Project) v. Electoral Commission (EU referendum expenditure rules). Gerard formerly taught constitutional law at Magdalen College, Oxford.
Gerard has particular familiarity with cases in the energy sector. He acted for Scottish Power in the CMA’s review of RIIO-T2 and RIIO-ED1 price controls, for the Utility Regulator in the GD17 licence modification appeal, and in numerous judicial review proceedings concerning Ofgem.
