Founded in 1990 by Mark Lanier, The Lanier Law Firm represents a variety of individuals and businesses. The firm is home to some of the nation’s most respected trial lawyers, and has compiled an impressive record of courtroom wins and significant settlements that have impacted millions of individual consumers. The firm’s attorneys offer a distinct blend of compassion, empathy and zealousness, and are committed to achieving nothing less for their clients than the most comprehensive remedies available under law.
Main Areas of Practice:
Pharmaceutical & Medical Device Litigation:
The Lanier Law Firm is a pioneer in its involvement in numerous claims involving pharmaceuticals and medical devices. The firm garnered national attention in winning a substantial verdict against Merck & Co. in the very first VIOXX lawsuit to go to trial, as well as securing two additional significant plaintiff verdicts.
In 2018, the firm secured a $4.6 billion verdict on behalf of 22 women and their families against Johnson & Johnson, based on the company’s knowledge and negligence regarding the toxic effects of talcum powder use. The trial presented evidence that Johnson & Johnson’s Baby Powder and Shower to Shower products have been tainted with asbestos for decades, despite the company’s repeated denials.
Since 2016, the firm has secured three separate jury verdicts totaling nearly $2 billion against Johnson & Johnson and its subsidiary DePuy Orthopaedics Inc. on behalf of individuals injured by defective metal-on-metal hip implants. While each of these awards was later reduced to align with Texas state laws limiting punitive damages, in each of these cases jurors concluded that the devices are defective and that company officials knew about the flaws but failed to warn patients and doctors of the risks.
The firm has also represented clients who have suffered injuries involving such dangerous drugs as Risperdal, Xarelto, and Actos. In 2015 the firm was instrumental in negotiating a sizeable settlement with drug manufacturer Bayer HealthCare Pharmaceuticals Inc. on behalf of thousands of women who suffered life-altering side effects after taking the prescription birth control pills Yaz, Yasmin and Ocella.
Product Liability & Personal Injury Litigation:
The firm has extensive experience representing those injured as a result of other types of defective products and corporate negligence. When faced with the often significant legal resources of these defendants, the firm’s decades of courtroom experience and state-of-the-art preparation put its clients on a level playing field with major insurance companies as well as the designers, manufacturers, suppliers and retailers of defective products and processes.
Asbestos & Toxic Exposure:
The firm is one of the nation’s most experienced in assessing the scientific and medical issues that are common in asbestos and toxic exposure claims. Exposure to common chemicals that have many positive and helpful uses also can be dangerous or even fatal. The firm has represented dozens of families and victims of chemical exposures, winning substantial recoveries based on the defendants’ liability for marketing and design defects, negligence and malice. This experience and reputation for courtroom excellence gives the firm added leverage to negotiate significant settlements in advance of trial.
In addition to representing individuals, the firm has significant experience working on behalf of businesses in cases involving breach of contract, patent infringement, oil and gas litigation, employment disputes, antitrust, fraud and other causes of action. In several instances these legal actions have been brought against companies using unfair and illegal business practices to gain a competitive edge. The firm’s aggressive approach to business litigation has resulted in several noteworthy — and often highly confidential — recoveries for its clients. The firm obtained a precedent-setting settlement for a national sugar association trade group and several manufacturers regarding a false promotion lawsuit against one of the world’s leading distributors of artificial sweeteners. The firm reached a sizeable settlement for syringe manufacturer Retractable Technologies in an antitrust case against Becton Dickinson & Company, a case which served as the basis for the movie ‘Puncture.’ The firm also secured a settlement for 130 Ingersoll Rand employees in a lawsuit over unpaid bonuses related to the sale of a corporate subsidiary.
The firm’s attorneys have decades of experience representing patients and family members in cases arising from medical malpractice, and have obtained substantial recoveries on behalf of those who have been catastrophically injured or killed due to medical negligence. This work includes cases involving infants who have sustained birth injuries, as well as patients whose physicians have failed to diagnose cancer, and cases of nursing home abuse and neglect.
Maritime Law Litigation:
The firm has represented a broad range of clients in maritime-related disputes, including Jones Act (Seaman’s injury) cases; cargo carriage disputes; oil spills; water pollution claims; vessel financing, operation, construction and re-building disputes; maritime liens; commercial/ contractual claims (including charter parties); and a variety of other maritime disputes. Several of the lawyers at the firm have a wealth of knowledge concerning this area of law, including advanced degrees and specialized maritime law designations.
Product Liability & Personal Injury:
When a consumer buys a product, they rightfully expect it to perform safely and efficiently. Unfortunately, that isn’t always the case. Use of defective products can result in tragic consequences. For years, the firm has represented consumers who have been seriously injured by defective products, both at home and in the workplace, as well as those injured as a result of the negligence of others. The firm’s decades of courtroom experience and state-of-the-art preparation puts clients on a level playing field with the insurance companies they are fighting. Their attorney’s work has resulted not only in financial recoveries, but has also put pressure on manufacturers to design safer toys, furniture, automobiles, and other products. While no amount of money can truly compensate clients for a debilitating injury or the loss of a loved one, there is gratification in knowing that future consumers might not be put at the same risk.
The Lanier Law Firm continues its tradition of fighting for those who have been injured by the negligence of others by applying its expertise to the Federal Employers’ Liability Act (FELA) claims of railroad workers. Congress passed the Act in 1908 to provide compensation to railroad employees who were injured on the job where it can be shown that it was the railroad’s negligence that caused the injury.
