Enforcement Funding: How Funding and Management of your Uncollected Judgment or Award can Directly Benefit your Bottom Line

Without a plan to collect, a hard-won judgment or award can be little more than a very expensive piece of paper. In today’s international business environment, reluctant debtors are increasingly savvy in diluting their creditors’ claims and increasing the time and expense for creditors to recover—including by creating sophisticated corporate asset protection structures and moving assets to opaque or difficult-to-reach jurisdictions.

Securing a recovery often requires investment in a multidisciplinary team of specialized counsel in several jurisdictions whose actions must be coordinated to maximize the chances of success. Faced with the task of managing a multi-jurisdictional recovery effort and the risk of throwing “good” money after “bad,” it is little wonder that claimants question whether there’s any value in further pursuing their claim—or whether they should simply record the loss and move on.   

This panel will discuss: 

  • How clients, lawyers and a funder specializing in judgment and award enforcement can team up to get clients a recovery so they can reap the rewards of the judgments they fought so hard to obtain, while limiting or entirely removing the need for further expenditure of time and money.

Michael Mcilwrath, Founder and CEO, MDisputes

Madoff Investment Securities LLC, Michelle has assisted on many aspects of the case, including the representation of the SIPA Trustee in adversary proceedings and appeals.

He has represented clients on the plaintiff and defense side in civil and class action lawsuits and helped recover assets globally.

Hannah van Roessel, Senior Investment Manager, Director Enforcement - US, Omni Bridgeway

Hannah van Roessel is responsible for the investment (litigation and judgment enforcement funding) requests under assessment at Omni Bridgeway’s US and EMEA Enforcement teams. Hannah brings with her broad experience in the litigation funding industry, including managing active enforcement cases and securing recoveries in contested settings. She has significant hands-on experience with the cross-border recognition and enforcement of arbitral awards on the basis of the New York Convention in a large number of jurisdictions and especially against sovereigns and semi-sovereigns.

Simon Christian, Research Director, Chambers and Partners
