About

Provided by Wolf Theiss

Our collaborative approach in Restructuring/Insolvency involving practitioners from several legal fields allows us to assist our clients with the best appropriate advice in Austria (and the CEE region).

Our Team
Our Restructuring/Insolvency team consists of a strong collaboration of lawyers from different practice areas primarily insolvency, corporate and finance lawyers who work closely together and contribute to the practice based on their special expertise.

Our Role
We assist in deleveraging bank assets and provide advice on sensitive bankruptcy filings and restructurings to help minimize future legal challenges, potential liability hazards and risks of a successful challenge to a transaction as being preferential or set aside under avoidance rules. We also advise on turnarounds, asset protection and recovery from a commercial perspective as well as in relation to banking, corporate and litigation laws.

Our Cases
We advise on key complex deals in the market, such as the high-profile HETA case: Following the acquisition of Hypo Group Alpe Adria ("HGAA") from Heta Asset Resolution, we have continued to advise Advent International/EBRD, now sole shareholder of HGAA, the (former) banking holding of the SEE network of HETA ASSET RESOLUTION AG ("HETA") comprising seven banks and three leasing companies in seven jurisdictions, in the restructuring of funding lines amounting to EUR 2.2 billion provided by HETA / ultimately the Republic of Austria.
