They are experienced in tackling different types of cases, adapting skills required depending on the regulator and facts.
The team consistently updates policyholders via newsletters, articles and webinars regarding changes in the law. Health & Safety is at the forefront of those legal updates; for example, the Head of Regulatory, Stephanie Thirlwell is currently working with a global risk management and strategy company and event companies across the UK to offer training in respect of Martyn’s Law and the Protect Duty.
Rupert Nevin and Stephanie Thirlwell have recently been involved in training a Health & Safety consultancy firm in respect of legal updates and the benefit of legal privilege in health and safety investigations.
The team has a delegated authority to act in all cases in the sector by AXA, one of the world’s largest insurers. Companies holding the AXA Management Liability Policy are afforded cover for investigations and enforcement action by any official regulator.
The MLP is AXA’s most successful insurance product, and the extent of AXA’s client base - from blue chip companies to SMEs - means that the health & safety work the regulatory team deals with is extensive, wide ranging and often very complex, involving cross agency prosecutions and inquest proceedings.
