Proskauer’s ERISA litigation team is a key component of the firm’s nationally renowned Employee Benefits & Executive Compensation Group, a national practice with over 40 lawyers in five different U.S. offices – Los Angeles, New York, Boston, Washington, DC and New Orleans. Our ERISA litigation team has deep experience in litigating every employee benefits issue our clients face. We handle employee benefits cases nationwide and have prevailed in many landmark decisions on behalf of our clients. We are the go-to nationwide team for the defense of significant “bet-the-company” ERISA lawsuits and therefore has led to being sought out to write amicus briefs on key issues before the Supreme Court and Appellate Courts. In addition, we frequently work with clients before lawsuits arise, giving them the option of avoiding litigation altogether. We act as full service ERISA counsel to an extensive client list, and are also sought out specifically to handle high stakes ERISA litigation by new clients who have not previously engaged us. As a result, we have handled the full gamut of litigation matters facing employee benefits practitioners, with a special emphasis on cutting-edge ERISA issues. These include class action and individual claims relating to claims alleging 401(k) plan investment options charge excessive fees and underperformed; company stock fund litigation; claims for pension and other benefits; and private equity, emerging markets or other exotic forms of investments.
