The Morris Nichols Business Reorganization & Restructuring Group regularly serves as lead or co-counsel for publicly-traded and privately-held debtors in possession, official creditors’ committees, bondholders’ committees, secured and unsecured creditors, pre- and post-petition lenders, equity holders, purchasers of assets and variety of other parties-in-interest.  These representations require skillful negotiating and masterful knowledge of the specific practices and procedures regarding insolvencies and of the Delaware Bankruptcy Court and District Court as well as the U.S. Court of Appeals for the Third Circuit. 

Since 1990, Delaware has been the venue for nearly half of the nation's largest bankruptcy cases.  Morris Nichols has represented debtors, committees and other key parties in many of these sophisticated proceedings.  The team also collaborates with the Firm’s other practice groups, particularly colleagues practicing business and corporate litigation, real estate and corporate and commercial counseling to provide clients with the exceptional knowledge and experience needed for complex restructuring and workouts.  Having handled some of the nation’s largest bankruptcy cases, Morris Nichols has the resources and experience to assist troubled businesses and other major parties in large, complex proceedings.
