Gaw | Poe represents both plaintiffs and defendants in its complex commercial litigation practice. In recent years, the firm has successfully certified class actions in two different lawsuits, single-handedly stopped a nationwide scheme by a consortium of law firms to extort small businesses through threatened Lanham Act lawsuits, and obtained favorable jury verdicts and/or arbitration awards in multiple cases worth between $3-11 million.
We have a special expertise in litigating disputes involving startup founders. We represented one founder in an earnout dispute and obtained an $11 million arbitration award for him. We represented another founder who had a large portion of his equity clawed back. We prevailed in arbitration and our client received a full return of his equity—worth approximately $10 million.
We also litigate class action claims brought under California’s Automatic Renewal Law (ARL), both on the plaintiff and defense side. We are currently litigating a class action on behalf of all California-based subscribers to the OnlyFans platform for failing to comply with the ARL, where hundreds of millions are at stake. Another example of our class action work is AdTrader v. Google. We represented a certified class of advertisers who sued Google in connection with its various advertising programs for failing to issue refunds for invalid ad traffic. That case resolved with advertisers receiving about $82 million in relief, including $7 million in a class settlement
