Dorsey’s role as lead counsel in the trial and Eighth Circuit proceedings that culminated in a 5-4 United Supreme Court decision in Thole v. U.S. Bank N.A., 140 S. Ct. 1615 (2020), that curbed ERISA plan participant standing on constitutional grounds, as well as its leadership role in the In re EpiPen ERISA class action that challenged the nation’s pharmaceutical distribution system, has recently enhanced Dorsey’s role as a national ERISA litigation firm. Clients have included UnitedHealth, which now relies on Dorsey to handle class actions and other complex matters not only in Minnesota, but in California and elsewhere around the country.
