Our competition team is recognized as a leader in the Competition and State Aid practice area in Romania. D&B lawyers have a recognized academic activity and extensive experience. Together with our clients, we contribute to strengthening competition and progress in Romania. Our expertise includes:

• specialist legal advice on the interpretation of Romanian and EU antitrust legislation (anticompetitive practices, economic concentrations, unfair competition, as well as state aid);
• legal assistance and representation in front of the Romanian Competition Council;
• reviewing and analyzing the clients’ past and future operations from an antitrust perspective and assessing any notification or approval requirements of the Competition Council/European Commission;
• analysis of clauses with a potentially anticompetitive effect in various agreements, pricing policies likely to be deemed restrictive of competition on the relevant market (in case of vertical/horizontal agreements or abuse of dominant position);
• legal assistance and representation in front of the Romanian courts in competition cases seeking the annulment of decisions or reduction of fines issued or imposed respectively by the Competition Council;
• legal assistance and representation in seeking state aid (e.g. obtaining various permits from the relevant authorities, preparing the file for obtaining state aid, either in the guise of individual state aid or allocations from a pre-existing state aid scheme).
