CMS Grau has strong experience dealing with cross/border insolvency issues, cases with international implications and issues, bankruptcy take/overs, bankruptcy cases with strong regulatory and social aspects, distressed M&A, debt refinancing, reorganization proceedings, preparation and negotiation of reorganization plans, exit strategies, bankruptcy liquidations, out-of-court reorganizations. Nowadays, CMS Grau is working jointly with international law firms in Chapter 11 cases.
The team advises clients from all sectors, including consumer products, mining, TMC, energy, fishing, among others, and participates in key cases, including 2 of the most complex bankruptcy cases in the country.
The lawyers’ broad expertise ranges from debt refinancing, reorganisation proceedings of international group of companies, bankruptcy proceedings and related contingencies, including arbitration and legal processes, including experience appearing before INDECOPI’s bodies (Commission, Technical Secretary and Tribunal) and before Court and Arbitral Tribunals. The team constantly coordinates with accountants, auditors, business consultants and relevant bodies of the companies we advise such as board of directors, shareholders, commercial managers and accounting department.
CROSS-BORDER CASES: The team provides advice in a complex bankruptcy Chapter 11 (reorganisation) case in New York together with Skadden Arps Slate Meagher & Flom LLP. The company’s main assets are located in Peru.
