The team advises on the Clean Air Act (CAA), Clean Water Act (CWA), Oil Pollution Act, RCRA, CERCLA, NEPA, Coastal Zone Management Act, Mississippi Coastal Wetlands Protection Act, state tidelands law, and state water law. Balch also handles air, water, wetlands, solid waste, hazardous waste, NPDES, Section 401, Section 404, Title V, PSD, NSR, coastal development, environmental due diligence, brownfield redevelopment, plant siting, and environmental issues in corporate and real estate transactions.
Balch has played a leading role in Mississippi’s Deepwater Horizon restoration efforts, including matters involving the Oil Pollution Act, RESTORE Act, Natural Resource Damage Assessment (NRDA) process, and Gulf Coast restoration funding. The team also advises on environmental compliance, NEPA review, federal grant and award requirements, disaster relief programs, and matters before the EPA, U.S. Army Corps of Engineers, and Mississippi Department of Environmental Quality.
