The client bases their business model on the information provided by their adviser, in this case, their lawyer. To better address the challenges posed by the economic climate, lawyers should provide their clients with valuable advice on risks and/or potential growth opportunities. The reliability of the lawyer’s analysis is therefore crucial and constitutes the “starting block” for any investor (client) wishing to launch a business. Thus, lawyers must position themselves as a strategic resource serving businesses and individuals both nationally and internationally.

The Level of Activity, Trends and Developments

The level of activity within the legal profession in the Republic of Congo is quite high. Over the years, lawyers have become increasingly prominent in the business world because they are the professionals best equipped to effectively meet the complex and diverse needs of today’s businesses. This is due to the exponential increase in demand from companies for assistance in all areas of law. It is therefore clear that the activities of a lawyer are no longer limited to defending the interests of a company before the courts. Lawyers are indispensable strategic partners throughout the life of a company, and their contribution is increasingly required in the pre-litigation phases. There is also a growing demand for lawyers’ expertise in areas such as legal advice, compliance, due diligence and M&A. In light of economic and legal developments, the lawyer secures growth and anticipates potential risks while complying with current legislation.

The conduct of economic activity inherently involves risk, and this risk must be assessed. It is at this level that the presence of a lawyer is undeniably essential. The lawyer must define and quantify this risk in favour of their client. This risk could also arise from the improper execution of a court decision. This new law could drastically alter the company’s tax and financial situation. Here, the lawyer’s role is to assist their client in understanding and applying the provisions of this law.

Potential Hurdles or Difficulties Faced by Clients and How These Can be Overcome

The potential obstacles and/or difficulties encountered by clients vary from case to case. We advise multinational companies in the oil, gas, mining, maritime transport and forestry sectors. However, law remains a profession requiring meticulous analysis and nuance. New technologies, in this case artificial intelligence, can assist, but they will never replace human judgement. Our files require careful reading of the details because it is often in these subtleties, which artificial intelligence cannot compensate for, that decisions are made.
