Losing a sponsored job does not end your right to stay overnight, but it starts a tight legal countdown. Your employer reports the end of your job to the Home Office, which sends you a curtailment letter that shortens your visa to 60 days. People who assume they have weeks to spare are the ones most likely to overstay after they lose their Skilled Worker job UK rights.
- The 60 day rule: runs from the date the letter is sent
- Your right to work: ends the day your sponsorship stops
- Dependants: your family's visas end on the same date
- New sponsor salary: £41,700 a year, or the going rate, whichever is higher
Is Your Visa Cancelled Automatically?
- Your visa is not cancelled the moment you stop working
- It stays valid until the Home Office sends a curtailment letter
- The curtailment period is usually 60 days, but if your visa expires within those 60 days, your original expiry date still applies.
- You cannot start a new sponsored job during limbo without a new visa
What Is a Curtailment Letter?
A curtailment letter is the Home Office notice that your visa has been shortened, usually to 60 days. The clock runs from the date the letter is sent, not your last day at work.
When the Clock Starts
The Home Office can send the letter to your home, your email, or place it on your file if your contact details are out of date. A letter placed on file still starts the 60 days, even if you never see it. Check your UKVI online account the moment your job ends.
If the Letter Never Arrives
A missing letter does not protect you. If the Home Office placed it on your file, your 60 days may already be running. Check every email account against the address linked to your UKVI account.
The 60 Days: What You Can and Cannot Do
Working During the 60 Days
You lose the right to work the day your sponsorship ends. The only exception is finishing a notice period with the same employer. Taking on a new job before a fresh visa is granted is illegal working and can lead to removal and a re-entry ban.
Travelling During the 60 Days
If you lose your Skilled Worker job UK status, leaving the country during these 60 days is risky. You may be refused entry on your way back. Do not leave unless you have decided to leave for good.
Finding a New Sponsor in 2026
If you lose a Skilled Worker job UK status only briefly, a new sponsor within 60 days is the cleanest option. Three things must line up.
- A licensed UK employer willing to issue a Certificate of Sponsorship, which backs your new visa
- A salary of at least £41,700 a year, or the higher "going rate" for that job
- English at level B2, the standard for new Skilled Worker applicants from 8 January 2026
The salary test is the most common reason a new offer fails after you lose your Skilled Worker job UK rights. Many candidates accept verbal offers only to find the salary is below the going rate. A Y & J Solicitors makes sure that the candidates pass all 3 of these requirements before talking on a visa case.
Alternative Routes If No Sponsor Is Found
- Global Talent for those recognised in science, engineering, technology, the arts or academia
- Innovator Founder for those with a backed business idea and required investment
- Family or partner routes, such as the spouse visa if your partner is British or settled
- Student route with an offer from a licensed UK college or university
- Dependant visa if your partner holds a visa that allows them to bring you
A new application must be filed before the 60 days end to keep your stay legal.
What Happens to Your Dependants
Their visas are also shortened on the same date as yours. Each dependant must leave, switch visa, or join your new application. Additionally, make sure that the school places and rental contracts are checked against the new deadline.
Avoiding Overstaying: The 10 Year Ban On Returning
- Work out the exact end date from your curtailment letter, not your job end date
- Decide within the first two weeks: new sponsor, switch visa, or leave
- File any application from inside the UK before the 60th day to keep your stay legal
- Leave before the deadline if no application is realistic, since overstaying can trigger a 10-year ban
The first week is the most useful part of your 60 days. If you found a new sponsored job, A Y & J Solicitors offers immediate visa processing so you can file your new visa before your curtailment ends.
