With its judgment of January 24, 2025 (2 O 46/22), the Mannheim Regional Court dismissed a patent infringement action filed by Pantech Corporation.

Pantech sued several Wiko companies in 2022 before the Mannheim Regional Court for infringement of the European Patent EP 2 227 923 (EP 923).

Upon a nullity action filed by Wiko before the German Federal Patent Court that led to a stay of the infringement proceedings, EP 923 was partly revoked by judgment of the Patent Court in 2023 (appeal pending). Pantech asked to resume the infringement proceedings based on the limited claims. Following the oral hearing on October 29th, 2024, the Mannheim Regional Court agreed with Wiko and found that the suit is dismissed for lack of infringement of the patent-in-suit. Against this background, there was no decision on the FRAND defense. The judgment may be appealed by Pantech.
