ZRp acted for International Islamic University Malaysia (also known as "Universiti Islam Antarabangsa") ("IIUM"), the Applicant in an application for judicial review of the Industrial Court's decision that the Claimant/First Respondent's dismissal from service was without just cause or excuse. The Claimant/First Respondent, a lecturer, was dismissed from employment for failing to obtain a PhD degree, as contractually required. The High Court affirmed the stricter rule regarding pleadings applicable in industrial relations cases and allowed IIUM's application solely on grounds that the Industrial Court had committed an error of law by exceeding the bounds of pleadings. This is notwithstanding that the evidence in support of such unpleaded point had been adduced without objection and the unpleaded point was fully argued before the Industrial Court.
