The EU Commission launched a series of consultations to gather feedback assisting in the review of the PSD2. These include a targeted consultation to professionals such as payment service providers, non-licensed providers, other players in the payments market, national authorities, etc. We recommend answering to this consultation to any professional concerned by the PSD2 framework. 

Deadline. Responses to this targeted consultation are possible until July, 5th.

🔎 Topics. The main topics covered by the targeted consultation are:

👉 The scope of the PSD2, to assess in particular whether Article 3 on exemptions should be amended,

👉 The addition of new regulated services such as payment transactions using crypto assets, digital wallet services, BNPL services,

👉 Any necessary changes in the methods for calculating a payment service provider’s own funds,

👉 Potential regulation of the “triangular passporting” which is defined by the EU Commission as the case where an authorized service provider in a Member State A makes use of the services of a service provider (e.g. an agent) in a Member State B in order to provide payment services in a Member State C.

In parallel, a general public consultation and a targeted consultation on open finance have also been launched.
