Fanny Yolima Rueda applied for the registration of trademark “La Casita Roja & Design” in class 43. Posse Herrera Ruiz as legal counsel to BANCO DAVIVIENDA S.A. filed an opposition providing significant evidence proving the notorious character of its registered trademark “La Casita Roja” in class 36.
The Trademark Office ruled that the evidence was conclusive and declared the notoriety of trademark “La Casita Roja” to cover financial and monetary services in class 36. Said entity also denied registration for trademark “La Casita Roja & Design” in class 43, arguing that its registration would allow its owner to take advantage of the notorious trademark’s reputation.
