We are pleased to share that our Managing Associate, Mariana Antonovych, and Associate, Arina Kolesnyk, as part of a Ukrainian Arbitration Association’s Working Group, contributed pro bono to an Amicus Curiae Brief for the Supreme Court (Case No. 910/11283/25).

This case touches upon fundamental principles of arbitration. By clarifying the ‘fallback’ mechanisms for appointing arbitrators, the brief reinforces the stability of arbitration agreements and the country’s reputation as a reliable, arbitration-friendly seat.

On 23 February 2026, the Supreme Court set aside the decision of the Northern Appellate Commercial Court and remitted the case for reconsideration, noting that the appellate court had adopted an overly formalistic approach to the interpretation of the arbitration agreement.
