ZRp acted for International Islamic Univiersity Malaysia (also known as "Universiti Islam Antarabangsa") ("IIUM"), the Respondent in this case before the Industrial Court, where the Claimant claimed that she was dismissed by IIUM, and it was done without just cause or excuse. The Claimant's employment with IIUM ended consequent to the expiry of her fixed termed contract. The Claimant was previously employed with IIUM since 2004 on multiple fixed term contracts. The Industrial Court dismissed the Claimant's claim and held that there was no dismissal given that the Claimant was not a regular employee with security of tenure as she was appointed on a genuine fixed term contract, which consequently expired. This is premised on the fact that permanent positions within IIUM are subjected to the approval of Public Services Department, which did not include the Claimant's position. Thus, it mitigates the argument of reasonable expectation.
