The International Arbitration team of LCF Law Group – led by Counsel and Head of practice Olga Kostyshyna, together with Senior Associate Polina Bitiuk and Junior Associate Kateryna Lykhopeka – successfully represented an agro-industry client in a dispute before the International Commercial Arbitration Court (CAC) at the Ukrainian Chamber of Commerce and Industry. The case concerned around the recovery of a substantial advance payment under a cross-border sales contract and raised complex issues of procedural succession and the scope of the arbitration agreement. The proceedings were further complicated by the involvement of a third party and a series of legally ambiguous agreements that challenged both the performance of the client’s obligations and the tribunal’s jurisdiction.

Although our team joined the case after the client had already filed the claim, we managed to build an effective strategy that resulted in a favorable award.

In particular, the LCF team:

  • confirmed the ICAC’s jurisdiction to hear the dispute
  • prevented attempts to shift liability onto the third party
  • substantiated the client’s claims through a carefully constructed evidence base
