King Stubb & Kasiva (KSK) has successfully secured an ad interim ex parte temporary injunction on behalf of its client, Mythri Movie Makers, before the Hon’ble CCH23 XXV Additional City Civil and Sessions Judge, Bengaluru, in a significant matter concerning defamatory and malicious online content relating to the film Irumudi  

The Hon’ble Court, upon consideration of the Plaintiff’s case, was pleased to grant the ex parte temporary injunction on the very day of filing of the suit, restraining the defendants, including X Corp, their GPA holders, agreement holders, agents, representatives, persons acting through them, and all persons claiming through them, from publishing, posting, sharing, uploading, streaming or commenting upon any false, defamatory, derogatory, malicious or damaging reviews and content relating to the film Irumudi 

The Court observed that the Plaintiff had established a prima facie case, that the balance of convenience lay in its favour, and that in the absence of interim protection, the Plaintiff would suffer irreparable harm - thereby justifying the grant of urgent relief. The Court further directed the Plaintiff to comply with the provisions of Order XXXIX Rule 3(a) of the CPC. 

The order underscores the importance of timely judicial protection against online defamation, malicious content and coordinated review-bombing, particularly where such content may adversely impact the public perception and commercial interests of a film ahead of its release.
