INTEGRITES successfully protected interests of a Ukrainian grain producer as respondent in a London-seated GAFTA arbitration. With the claimant being a Swiss subsidiary of a Chinese trader, the case involved international sales contract for Ukrainian feed corn.
The dispute arose out of non-delivery of the goods by Ukrainian seller under a contract governed by the English law. The respondent took the position that the claimant failed to provide delivery instructions to respondent in a timely manner or at all, thus, breaching the contract themself and precluding the seller to arrange the delivery of the goods within the agreed delivery period.
The tribunal upheld INTEGRITES team´s position and rendered an award in favour of the client.
