INTEGRITES successfully represented the interests of an Eastern European trader as claimant in a London-seated GAFTA arbitration against a Swiss trader as respondent under the sales contract concluded via broker.
The dispute arose due to avoidance of the contract by respondent and the latter’s refusal to compensate damages incurred by claimant. The contract was governed by English law.
Respondent refused to perform the contract because, inter alia, it has disputed the authority of the broker to conclude the contract on its behalf and questioned the identity of the client (arguing that another company from the client’s group of companies was a proper counterparty to the contract). As a result, the Tribunal upheld the INTEGRITES position and rendered an award in favour of the firm’s client.
