Ilyashev & Partners Law Firm has successfully protected the interests of a private client in a dispute with a private medical institution regarding the adverse effects of a plastic surgery procedure, securing the payment of fair compensation through an out-of-court settlement.

The client sought legal assistance from Ilyashev & Partners after undergoing plastic surgery at a private clinic in Kyiv, as the outcome proved unsatisfactory and led to severe complications. This resulted in the need for extensive medical consultations, a secondary surgical intervention at another institution, and significant additional expenses for the patient.

The case was further complicated by the fact that, at the initial stage, representatives of the private medical institution refused to acknowledge any errors and showed no willingness to engage in a constructive dialogue or compensate for damages.

To protect the client’s rights, Alla Tsymanovska, Attorney at Ilyashev & Partners, implemented a comprehensive legal strategy: established an irrefutable legal position based on the analysis of medical records; initiated and conducted complex negotiations with the management and legal counsel of the medical institution; and filed an official complaint with the Ministry of Health of Ukraine, requesting a clinical and expert evaluation of the quality of medical care provided and compliance with clinical protocols.

Thanks to Ilyashev & Partners’ efforts, the negotiation process was resumed, the conflict was resolved out of court, and the parties signed a claim settlement agreement under which the client received full financial compensation.

“This case demonstrates that in medical disputes, an out-of-court settlement is the most effective and swift instrument for protecting patient rights,” noted Alla Tsymanovska. “The key to success in such matters lies in a consistent, documented position and the ability to combine mediation with the rigorous application of statutory mechanisms for monitoring the quality of medical care. This allows the client to receive compensation without years of exhausting forensic medical examinations and court hearings.”
