Ilyashev & Partners Law Firm provided effective legal support to the Municipal Non-Profit Enterprise Shyriaieve Central District Hospital in its interaction with the National Health Service of Ukraine (NHSU).

In March 2025, the hospital received an official inquiry from the NHSU regarding its compliance with the terms of the agreement under the Medical Guarantees Program. In particular, the inquiry raised concerns about potential violations related to the hospital’s obligation to ensure patients’ access to medications.

To ensure qualified legal representation, the hospital turned to Ilyashev & Partners Law Firm. Representing the client, Attorney at Law Alla Tsymanovska prepared a comprehensive written response that included a detailed legal analysis, a well-founded position supported by reporting data, relevant legal provisions, and the hospital’s primary accounting documentation.

As a result of the legal justification submitted, Shyriaieve Central District Hospital was not included in the list of institutions subject to funding suspension and continued to receive full financial support from the NHSU.

“This case clearly demonstrates the importance of a timely and professional response to NHSU inquiries, even in situations where medication expenses are not covered under the Medical Guarantees Program. We substantiated the legality of the hospital’s actions in detail, which helped not only to maintain funding but also to uphold the institution’s reputation,” said Alla Tsymanovska.

Exclusion from the Medical Guarantees Program, as defined by the Law of Ukraine “On State Financial Guarantees of Public Health Care,” could have resulted in the termination of public funding for medical services and pharmaceuticals. This would have made it impossible for the hospital to fulfill its contractual obligations and could have jeopardized patients’ access to guaranteed free medical care (Articles 3, 4, and 8 of the Law).

Reinstating a healthcare facility into the Program requires the elimination of the identified violations, a follow-up inspection by the NHSU, execution of a new healthcare services agreement, and full compliance with all procedural requirements. This process can take several weeks to several months, depending on the circumstances.
