Mr Justice Jay has refused permission to apply for judicial review of a decision by LB Camden to grant itself planning permission and listed building consent for a major development in Somers Town pursuant to its Community Investment Programme (R (Devlin) v. LB Camden (CO/5992/2016)).

The proposed development included 136 residential units as enabling development to fund the provision of a replacement school, replacement and new community facilities and enhanced public open space.

An application for permission to apply for judicial review was made by the Chair of the Somers Town Neighbourhood Forum on grounds related to the interpretation of London Plan Policy 7.18 (Protecting open space) and LB Camden's Core Strategy Policies governing the distribution of growth. 

After an extended oral permission hearing, Mr Justice Jay refused permission on the basis that neither ground had any realistic prospect of success.
