KP Energy Limited and Aditya Birla Renewable Energy Limited (“Power Developers”) are in process of developing 200 MW hybrid power plant in the state of Gujarat. For supplying power to their off-takers, they have been granted the right to access transmission asset of GETCO.

Power Developers had commissioned more than 50% of the generation capacity. Remaining capacity couldn’t be commissioned due to occurrence of various unforeseen events.

Dentons Link Legal (“DLL”) approached GERC and prayed for interim relief which was vehemently opposed by GETCO.

GERC reviewed all submissions including submission on part-commissioning. GERC also recognised revocation of the connectivity at this stage will not be beneficial for GETCO as well.

Agreeing with our submissions, GERC issued interim order restraining GETCO from taking any coercive action including revocation of the connectivity.
