On October 10, 2024, DSK Legal filed an appeal in the Rajasthan High Court concerning a trademark dispute related to the film "Jigra," set to be released tomorrow, October 11, 2024. The appeal arose in a suit filed by a party claiming that the film's title infringed upon a registered trademark "Jigra," registered under Class 41 of the Trademark Act.
On October 8, 2024, the Commercial Court issued an ex-parte order restraining Dharma Productions from releasing the film. The production team became aware of this order only on the morning of October 10, prompting immediate action.
DSK Legal promptly filed an appeal challenging the validity of the Commercial Court's restraining order, and requested an urgent mentioning of the appeal before the Division Bench of the Rajasthan High Court, which was granted, allowing the matter to be heard the same day at 2 pm.
After hearing counsel the Hon’ble High Court granted an ad interim order staying the operation of the Commercial Court's order of injunction. The Hon’ble Court expressed a prima facie view that the title "Jigra" used for the film did not infringe the claimant's trademark rights. The Hon’ble Court noted that the production house was not trading under the name "Jigra," thus mitigating claims of trademark infringement. The Hon'ble High Court's ruling enables the film to be released as scheduled on October 11, 2024.
