Dmytro Marchukov, senior partner and co-head of Cross-Border Litigation and Private Clients at INTEGRITES, spoke at the 18th С5 Fraud, Asset Tracing & Recovery conference in Geneva.
This year Dmytro participated in the two panel discussions on How to Handle the Heat: Navigating the Emotional Side of Fraud & Asset Recovery Disputes and Interactive Think Tank: Cross-Border Procedural Tricks and Traps. The interactive sessions gathered dispute resolution and forensic specialists from the United Kingdom, Germany, Poland and Ukraine who shared the stories of the most highly contentious and emotionally charged disputes in their practice, as well as discussed the procedural tools and limitations in their respective jurisdictions. In particular, the distinguished speakers focused on cases when parties try to baffle the opposing counsel by commencing civil, criminal or disciplinary proceedings against them and considered how the coordinated use of legal mechanisms available in civil and common law countries can boost cross-border asset recovery strategies.
Dmytro Marchukov: “C5 Geneva event has traditionally been very comprehensive in raising the issues, which are relevant to combatting and investigating international fraud, tracing assets globally and enforcing claims against them. That could be seen very well from the topics, on which I was invited to speak. Together with my fellow panellists we were able to demonstrate (yet again) that cross-border disputes are not LEGO with user-friendly manuals but, rather, that they require thorough coordination and understanding of which legal instruments can be utilised in each of the jurisdictions involved. It was, of course, also very much interesting to take a rare look at international dispute resolution from the perspective of legal teams and not just the litigants represented by them.”
In the past decade, Dmytro Marchukov has often been invited to speak at the C5 Fraud, Asset Tracing & Recovery conference in Geneva. In particular, in 2023 he discussed coordination of efforts between authorities of various states with the view to assist in recovery of assets by private creditors.
