Dentons Link Legal represented JSW Energy before the Supreme Court of India in a matter concerning the Generation Based Incentive framework for wind power developers.
In its judgment dated March 25, 2025, the Court examined the interplay between the jurisdiction of State Electricity Regulatory Commissions in tariff determination and the role of Central and State Governments in implementing incentive schemes. The Court held that while tariff determination remains within the exclusive domain of SERCs, such commissions are required to give effect to Central Government schemes.
