Dentons Link Legal successfully advised and represented a large multinational Indian automobile company in a complex arbitration and secured a favourable arbitral award in its favour.

The dispute arose under a Dealership Agreement, pursuant to which substantial sums payable to the Client remained outstanding despite repeated demands. The matter involved a detailed examination of contractual obligations, commercial practices, and financial claims. After a comprehensive review of the Dealership Agreement and extensive ancillary documentation, our team, initiated proceedings by filing an Application under Section 11(6) of the Arbitration and Conciliation Act, 1996 before the Hon’ble Bombay High Court, pursuant to which the Arbitral Tribunal was duly constituted.

Dentons Link Legal actively represented the client throughout the arbitral proceedings, which entailed intricate technical, financial, and contractual issues. The firm led the evidentiary and legal strategy, successfully demonstrating that the counterclaim raised by the Dealer was barred by limitation, factually incorrect, and devoid of merit, and that no set-off was permissible considering the facts. The Arbitral Tribunal allowed the Client’s claims in their entirety, together with interest, allowed full costs of matter to the client and rejected the counterclaim in full.

Throughout the proceedings, Dentons Link Legal provided strategic and commercially aligned advice at every stage, ensuring rigorous compliance with procedural requirements while effectively protecting and enforcing the Client’s rights and interests.

The matter was led by Mustafa Motiwala (Senior Partner) and Nihal Shaikh (Associate Partner), along with Nikhil Shirsekar (Associate) and Siddhi Phatkare (Articled Clerk).
