Dentons Link Legal advised AU Naturel Beauty Private Limited in a significant trademark dispute before the Delhi High Court arising from competing marks used in the cosmetics and personal care segment. The matter involved an appeal against an interim injunction restraining the use of the trademark “NEUDE”, which was alleged to be deceptively similar to the respondent’s registered mark “NEUD”. The dispute raised important issues relating to trademark coexistence, prior use, turnover claims, and the balancing of brand protection with commercial realities in interim relief proceedings.

We represented AU Naturel Beauty Private Limited in the first appeal under Section 13(1) of the Commercial Courts Act, 2015, successfully securing a modification of the impugned injunction order. The Delhi High Court permitted the client to transition to the mark “BE NEUDE”, holding that such use would eliminate any likelihood of confusion while recognizing the client’s substantial investments in branding and business operations. The Court also laid down a structured transition and stock-depletion framework, ensuring business continuity while safeguarding the interests of both parties during the pendency of the suit.
